Privacy policy

1. Scope

This policy describes how Janover Capital LLC ("Janover Capital", "we", "us") collects, uses, shares and protects information in connection with hudassistedliving.loan (ALF Atlas), which is operated by Janover Capital LLC. It applies to this site only. Other Janover sites and the third-party sites we link to have their own policies. By using the site you agree to this policy and to our Terms of use.

2. Information we collect

Financing inquiries. When you send the inquiry form, we receive your name, work email, phone number if you add one, your role, the facility name or CMS certification number, what you need, the approximate loan amount and timing if you give them, and your message. The form also sends, without you typing them, the page you sent it from, how you reached the site (the referring page and any campaign tags in the link you followed, kept in your browser for that visit only), and the consent sentence shown next to the button. Sent from the loan sizer page, it also carries the sizer's current inputs and results (care mix, beds, NOI, value, payoff and the loan each program sizes). Please do not include anyone's health information, resident names or medical details: we don't need them and don't want them.

Tools. The HUD vs Fannie Mae vs Freddie Mac loan sizer runs entirely in your browser. Nothing you type into it is sent to us unless you send the inquiry form on the same page, which carries the sizer's figures with it.

When you browse, our hosting provider, Cloudflare, processes technical information such as your IP address, browser type, the pages you request and the referring page, to deliver the site and protect it from abuse.

This site runs no analytics or advertising tools.

From other sources. If you go on to work with us on a financing, we may receive information about you or the transaction from public records, lenders and other transaction parties such as appraisers or title companies.

3. How we use information

We use it to reply to your inquiry and, if you ask us to, to evaluate, size and arrange the financing you request; to contact you by email, phone and text as described in section 5; to run, secure and improve the site; to comply with law and legal process; to enforce our terms; and to detect and prevent fraud and abuse. We may use aggregated or de-identified information, which does not identify you, for any lawful purpose.

4. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only as follows.

• Lenders and transaction parties, at your direction. If you ask us to look for financing, we share the deal and contact details needed with prospective lenders and the parties needed to evaluate or close it (appraisers, title companies, consultants, counsel). We don't send your inquiry to anyone before that.
• Service providers. Cloudflare hosts the site and stores form submissions in its database (Cloudflare D1). Our email provider delivers your request to our team. Each handles the information only to provide its service to us.
• Affiliates. Affiliated Janover businesses, for the purposes in this policy.
• Professional advisors. Our lawyers, accountants and insurers, as reasonably needed.
• Legal and safety. When we believe disclosure is required by law, regulation, subpoena or legal process, or is needed to protect the rights, property or safety of Janover Capital, our clients or others.
• Business transfers. In a merger, acquisition, financing, reorganization or sale of all or part of our business, information may transfer as a business asset.

5. Communications and your choices

If you give us your contact details, we may contact you by email, phone and text about your request and our services, as described in our terms. Consent to marketing is not a condition of any service. Reply STOP to any text to opt out, use the unsubscribe link in any marketing email, or contact us at (561) 559-4111 or hello@hudassistedliving.loan. We may still send messages about an active inquiry or transaction.

6. Cookies

This site sets no cookies. The inquiry form keeps the campaign tags and referring page of your visit in your browser's session storage, which is cleared when you close the tab. Your browser settings can block storage; the site still works. The site does not respond to "Do Not Track" signals. Where the law requires it, we honor opt-out preference signals such as Global Privacy Control; we don't sell or share personal information for cross-context behavioral advertising in any case.

7. Retention

We keep information as long as reasonably needed for the purposes in this policy, including transaction records, legal, tax, accounting and regulatory requirements, disputes and enforcing agreements. Form submissions are stored in our Cloudflare database and deleted when no longer needed for your request or our records. When information is no longer needed, we take reasonable steps to delete or de-identify it.

8. Security

We use commercially reasonable administrative, technical and physical safeguards. No method of transmission or storage is completely secure. Please do not send Social Security numbers, account credentials or health information through the site's forms; if a transaction needs sensitive documents, we will arrange a suitable channel.

9. Your privacy rights

Depending on where you live, you may have the right to know or access the personal information we hold about you, to correct or delete it, to get a portable copy, or to opt out of certain processing. Much of what we handle relates to commercial transactions and may be exempt from some state privacy laws; we honor valid requests as the law requires. To make a request, contact us at hello@hudassistedliving.loan or (561) 559-4111 with your name, contact details and the request. We may need to verify your identity, and we will not discriminate against you for exercising a right. Authorized agents may send requests with proof of authority.

10. Children

This is a commercial finance site for adults. It is not directed to anyone under 18, and we don't knowingly collect their information. If you think a minor has sent us information, contact us and we will delete it.

11. Users outside the United States

The site is run from and meant for users in the United States. If you use it from elsewhere, your information will be transferred to, stored and processed in the United States.

12. Third-party links

The site links to government sources such as HUD, data.cdc.gov and each state's licensing agency and facility list, and to Creative Commons for our data license. This policy does not apply to those sites; read their policies directly.

13. Changes to this policy

We may update this policy. The new version will be posted here with a new effective date. Using the site after that means you accept it.
